Posting a three day notice is always a very intimidating thing. Will the tenant be there? Will I post the three day notice correctly? Will the tenant get mad and begin damaging my property? These are questions that typically run through a landlord’s mind when gearing up to remove a tenant. In addition to the landlord not collecting rent for the past several months now the landlord will have to pay to remove a tenant. Typically court fees alone cost around $300 in Palm Beach County.

After the three day has been posted the tenant will have three days to either pay or quit.

 

Calculating the three day period

The day of posting does not count towards the first day and neither do court holidays or weekends. So if you post on Monday, you will be able to go to the court house on Friday and file your eviction. Once your eviction has been filed it takes a few days for the court to serve the eviction notice on the tenant. Once the tenant is served with the notice of eviction, the tenant now has another five days to respond to the court. If the tenant does not respond then the court will issue a default on the tenant and a writ of possession will be issued and served by a Palm Beach County Sheriff Officer.

Now you may be asking, what happens if a tenant responds? Well if a tenant answers the Judge will likely set a hearing date and/or may require the tenant to pay rent into the court registry. If the Judge issues in favor of the Landlord then the Court will issue a writ of possession. At this point you or your agent will have to show up to the property with the Sheriff, a locksmith and someone to help remove the tenants belongings if the tenant is still in possession of the property.

Bottom line evictions are a nightmare for all parties involved.
